New Hampshire drug raid results in 20 heroin arrests

New England is in the midst of an opiate epidemic, according to a recent statement by U.S. Attorney Emily Rice to New England Cable News (NECN). There are different schools of thought as to the best way to deal with this epidemic. Some believe treating the addiction is best, others focus on punishment.

In the piece by NECN, Rice reiterated the importance of prosecuting individuals who are distributing heroin. This was highlighted in a recent drug raid in New Hampshire. The raid resulted in the arrest and indictment of over 20 people for heroin trafficking charges.

New Hampshire state law and penalties for heroin possession: New Hampshire has a reputation for taking drug charges seriously. With some of the harshest penalties in the nation, this reputation is well earned. Those facing these charges can benefit from a basic understanding of some of the penalties that can apply.

Penalties for possession of heroin can include:

  • First offense: even a first offense can lead to prison time. Generally possession of any amount of heroin is charged as Class B felony. This can come with a monetary fine of up to $25,000 and up to 3 1/2- 7 years in prison. Allegations of intent to distribute can increase these penalties.
  • Second offense: penalties increase significantly for a second offense. This can include up to a $50,000 fine and 7 1/2- 15 years imprisonment.

Penalties for accusations of distributing, or trafficking, heroin are even more severe and can include:

  • Less than one gram. Those who are accused of distributing even a small amount, defined as less than one gram, can face up to $100,000 in fines and seven years in prison.
  • One to five grams. Facing charges of distribution while in possession of this amount of heroin increases the monetary penalties to a maximum of $300,000 and up to 10-20 years imprisonment.
